Terms of service
The terms that apply to quotations, samples, orders and use of this website. For order-specific conditions, your signed quotation or sales contract takes precedence.
Last updated: 4 November 2026
1. About these terms
These terms govern your use of paintartbynumbers.com/ and any quotation, sample or order placed with PaintArt by Numbers ("we", "us"), a paint by numbers manufacturer in Shenyang, Liaoning, China. By requesting a quotation or placing an order, you accept these terms. Where a signed quotation, proforma invoice or sales contract states different terms, that document prevails for that order.
2. Quotations
Quotations are valid for 30 days unless stated otherwise, and are based on the specification, quantity and Incoterm stated in them. Prices exclude duties, taxes and import charges unless the quotation is expressly DDP. Changes to artwork, quantity, colour count, packaging or delivery terms may change the price, and we will reissue the quotation before production continues.
3. Orders and acceptance
An order becomes binding when we confirm it in writing and receive your deposit. We may decline an order, or stop work on an accepted order, if the artwork is unlawful, infringes third-party rights, or if payment obligations are not met.
- Deposit: 30% of the order value on confirmation for new and existing accounts, unless otherwise agreed in writing.
- Balance: payable before dispatch, after you approve the pre-shipment photo report.
- Accepted payment methods: T/T, Alibaba Trade Assurance, Western Union, and PayPal for sample-only orders.
4. Artwork and intellectual property
You confirm that you own or are licensed to use all artwork, logos and text you send us, for the purpose of manufacturing and selling the product, in the territories you name. You indemnify us against claims arising from artwork you supplied.
We do not resell, publish or reuse custom artwork supplied by a buyer. Artwork files remain your property; we keep them only to service reorders and, unless agreed otherwise, delete them 24 months after the last order. Where you buy a design from our catalogue, we grant you a non-exclusive licence to sell the resulting kits; catalogue designs are not exclusive unless a written exclusivity agreement is in place.
We may photograph finished production for our own records and, with your written permission, for marketing. We will not publish your designs, brand or relationship without that permission.
5. Samples and mockups
Digital mockups and artwork previews are indicative. Screen colour, print colour and paint colour will not match exactly. Pre-production samples are the definitive reference for bulk production; where no sample is ordered, bulk production is matched to the approved digital artwork and normal manufacturing tolerances apply.
6. Specifications and tolerances
Handmade and printed components carry normal tolerances: canvas dimensions ±1%, print colour within a reasonable commercial match, paint volume ±5%, and carton weight ±3%. Section counts, colour counts and design detail are subject to reasonable adjustment during artwork preparation, which we will confirm in writing before production.
7. Lead times and delays
Lead times run from the later of written artwork approval or receipt of deposit, and are estimates unless expressly guaranteed in writing. We are not liable for delay caused by events outside our reasonable control, including carrier or port disruption, customs action, government restrictions, energy restrictions, or force majeure. Where a delay occurs, we will notify you promptly and agree a revised schedule.
8. Delivery, risk and title
Delivery terms are as stated in the quotation (FOB Dalian, EXW, CIF or DDP). Risk passes according to the applicable Incoterm. Where delivery is FOB or EXW, you are responsible for booking freight and insurance from the agreed point. Title in the goods passes to you on receipt of full payment.
9. Inspection and claims
You must inspect the goods on arrival or arrange third-party inspection before shipment. Claims for shortage, visible damage or incorrect items must reach us within 14 days of delivery, with photographs and a count. Claims outside that window may not be accepted. Approved claims are settled by reprint, replacement or credit, at our discretion, within two working days of agreement.
10. Cancellation and changes
Orders may be cancelled before production artwork is finalised, with the deposit refunded less any design or plate work already completed. Once production has started, custom-manufactured goods cannot be cancelled, and the deposit is non-refundable. Post-production changes are treated as a new order.
Custom-manufactured goods are made to your specification and cannot be returned for change of mind or slow sales. Section 6 of our shipping and returns policy sets out what we do cover.
11. Compliance and product safety
We manufacture to the specification confirmed with you. You are responsible for confirming that the product, its labelling, age grading, language and barcodes comply with the law of the market you sell into, and for appointing any required importer or responsible person. Test reports we supply reflect the sample tested, not your final labelling decisions.
12. Limitation of liability
Our total liability for any order is limited to the invoiced value of the affected goods. We are not liable for indirect or consequential loss, including lost profit, lost sales, marketplace penalties, or the cost of promotional campaigns. Nothing in these terms excludes liability that cannot be excluded by law.
13. Website use
Content on this website is provided for information. Prices and lead times shown are indicative and do not constitute an offer. We may change specifications, availability and content without notice. You may not scrape, copy or republish substantial parts of this site, or use it in a way that interferes with its operation.
14. Confidentiality
Each party will keep confidential the commercial information received from the other — including pricing, customer lists and unannounced designs — and use it only for the purposes of the business relationship. We sign mutual NDAs on request.
15. Governing law and disputes
These terms are governed by the laws of the People's Republic of China. The parties will first attempt to resolve any dispute by good-faith negotiation within 30 days. Failing agreement, the dispute will be submitted to the competent court in Shenyang, Liaoning, unless the applicable Incoterm or a signed contract provides for arbitration elsewhere. Where the CISG applies, it is excluded to the extent permitted by law.
